Refund Policy
- Requests for refunds must be initiated within 30 days from the date on which the order for the related Gift Card was placed. Any refund request following the 30-day refund period will be denied by Tommy’s Express LLC and by the Franchisee.
- Refunds may only be requested prior to the use of the Gift Card, in whole or in part. Once a Gift Card is used to make a purchase, any refund request will be denied, even if there is still a balance on the Gift Card.
- Refunds may be requested by the Gift Card purchaser or recipient by sending an email request to: support@tommys-express.com. Each refund request (each, a “Refund Request”) must include the following information:
- The receipt of purchase;
- The name of the Gift Card purchaser;
- The date of purchase;
- The name of the Franchise location the gift card was purchased from;
- The order number
- The name and address (which may be an email address) of the recipient; and
- Contact information for the purchaser, including email address and contact phone number.
- Upon receipt of a Refund Request, Tommy’s Express LLC will promptly verify that the Gift Card has not been used. Gift Cards that have been used in whole or in part are not eligible for a full or partial refund.
- Upon receipt of a Gift Card Refund Request, and verification that the Gift Card to which the Refund Request relates is eligible for a refund, Tommy’s Express will make a determination regarding the Gift Card and will take one of the following actions:
- Deny a Refund Request and send the consumer an email that details why the refund request is denied; or
- Approve a refund and send the consumer an email that details the amount of the refund.
- Any refund amount that is approved will be credited to the original credit card used to purchase the Gift Card. If purchase was made in cash, you must refer back to the original location that you purchased your gift card in order to receive your cash refund. All refunds will be made within 60 days of the date on which the Refund Request was received.
- If for any reason a refund cannot be credited to the original credit card, Tommy’s Express will issue to the purchaser a check for the amount of the refund approved, less a $10 check writing and processing fee. The check will be processed and mailed to the consumer within 90 days of the Refund Request at the address specified by the consumer in its Refund Request.
Monthly Subscriber
By using the Tommy's Express Mobile App ("App"), you ("you" or "your") are agreeing with Tommy's Express LLC ("Tommy's Express") and the owner/operator of any Tommy's Express car wash you visit ("Operator") to the following terms and conditions ("Agreement"):
- You are making a purchase and registering for a Tommy's Express Unlimited Car Wash Club Subscription ("Subscription"), which is an automatic and recurring monthly subscription for unlimited car washes at a selected car wash level (i.e., quality, basic, the works, etc). Entering a promotional code will also register you for an automatic and recurring monthly Subscription once the promotional period expires.
- You will be charged a monthly Subscription fee based on the Wash Plan you have selected ("Subscription Fee"). The Subscription Fee will be an automatic and recurring monthly charge to your billing card. The Subscription Fee will be charged on the date you activate your Subscription, or if you subscribed using a promotional code, from the date the promotional period expires. The Subscription will automatically renew every month and the Subscription Fee will be charged to your billing card each month on the renewal date.
- You may deactivate your Subscription through the App any time and continue to wash through the Subscription end date. To deactivate by email or phone, please contact the Operator. If deactivating by email or phone, please allow a minimum of five business days, prior to the next renewal, to effectively deactivate your Subscription. Once deactivated, your billing card will no longer be charged the Subscription Fee.
- There are no refunds for lack of use during the subscription term or for partial months. To request a refund for any reason, you must contact the Operator within 45 days of your monthly subscription charge. Refunds will be granted or denied at the sole discretion of the Operator and Tommy's Express. Promotional Subscriptions must be deactivated prior to the monthly renewal in order to prevent an automatic renewal and avoid a charge.
- You may change your contact and billing information through the App at any time. It is your responsibility to provide and maintain a valid email address and phone number in the App to receive any changes or updates to the Subscription or this agreement.
- In the event Tommy's Express is unable to receive payment from you for reasons such as card expiration, non-sufficient funds, or change in information, your Subscription will be halted immediately, and you will not be able to wash your vehicle. If Tommy's Express is able to collect payment for your Subscription within 10 days after being halted, your Subscription will continue with your current Subscription renewal schedule. If Tommy's Express is not able to collect payment for your Subscription after 10 days from the halted date, your Subscription will be automatically deactivated. If your Subscription, it must be reactivated at our current retail pricing.
- The Operator of any car wash location reserves the right to close any location due to inclement weather, major holidays, equipment maintenance, wash site enhancements, or force majeure.
- Tommy's Express may increase monthly rates on 30 days advance notice by either the Operator posting at the car wash site or Tommy's Express sending notice to the email you have on file in the App.
- Tommy's Express reserves the right to change the payment amount to include tax at any time, or to reflect tax law changes in your home Subscription location.
- Each Subscription is intended for a single vehicle only. Fraudulent use of a Subscription will result in immediate termination of the Subscription. Multiple Subscriptions may be included in the same App account and billed to the same card.
- This Agreement is subject to change without notice.
- Subscriptions are redeemable at all Tommy's Express locations nationwide. Visit https://tommys-express.com/locations.
- The Subscription cannot be combined with any other programs or discounts, including but not limited to, pre-paid washes, vouchers, house accounts or coupons. It also does not apply to special event pricing.
- Promotional Subscriptions may be limited to single Tommy's Express locations. Pricing and participation may vary.
- You agree to allow Tommy's Express and the Operator to recognize and log your license plate number, and to collect, store, and use the personal information obtained through this App and your use of any Tommy's Express car wash in accordance with the Privacy Policy of Tommy's Express.
- When you create a first-time membership in the TommyClub app, you will be offered a month of free washing. This offer is only available to new TommyClub members or TommyClub app users who have never selected a wash plan for their vehicle. If you have created a membership at any point and currently have an active, paused, or cancelled membership, you are not eligible to receive the Free Month promotion. This promotion is available at participating stores only. New membership accounts can be created either in the TommyClub app or at the cashier window on site. If you sign up at the cashier window, you will need to download the app and claim your account, complete the sign-up process, and accept our Terms and Conditions in order to receive your Free Month. If you create a new account and use a gift card to pay for your first month of membership, you must select 'auto-renew' and enter a valid payment method in order to receive your Free Month. If you do not select 'auto-renew', you are not considered a TommyClub member and may not participate in our Free Month promotion.
- Each promotional code or coupon you use can only be used one at a time. You cannot stack promotional codes or coupons (including gift cards). If you attempt to simultaneously redeem multiple codes or coupons, only the last code or coupon entered will be active. If you have multiple codes or coupons, you must wait until your first code or coupon has expired prior to entering a new code.
Pay Per Wash User
By using the Tommy’s Express Mobile App (“App”), you (“you” or “your”) are agreeing with Tommy’s Express LLC (“Tommy’s Express”) and the owner/operator of any Tommy’s Express car wash you visit (“Operator”) to the following terms and conditions (“Agreement”):
- You are registering for a Tommy’s Express Pay Per Wash account (“Account”), which uses license plate recognition technology to allow you to wash your vehicle without swiping a credit card or handing cash to a cashier each time.
The billing card on file in your Account will be charged for every car wash you purchase. A car wash is purchased at the wash level you have selected on the App when a vehicle registered to your Account enters the wash lanes and the gate recognizes your vehicle. You may add multiple vehicles to your Account. You may select a different wash level in the App at any time, however, it may take up to 5 minutes for your selection to become active. Until that time, you will receive the wash level previously selected.
- Wash prices may vary depending on car wash location. Please review posted wash prices prior to entering the wash lanes. By entering the wash lanes and allowing our car to be recognized using license plate recognition technology, you are agreeing to pay the price of the car wash posted at that location for the wash level you have selected on the App.
- The Operator of any car wash location reserves the right to close any location due to inclement weather, major holidays, equipment maintenance, wash site enhancements, or force majeure.
- You may change your contact and billing information through the App at any time. It is your responsibility to provide and maintain a valid email address and phone number in the App to receive any changes or updates to the Subscription or this agreement.
- In the event Tommy's Express is unable to receive payment from you for reasons such as card expiration, non-sufficient funds, or change in information, your Account will be placed on hold, and you will not be able to wash your vehicle.
- You may upgrade to a Tommy’s Express Unlimited Car Wash Club Subscription at any time. Please note that once you subscribe, your card will be charged for the monthly cost of the subscription you have purchased. Please see Monthly Subscriber Terms and Conditions for more information.
- Pay Per Wash access via your Account is currently available only at select Tommy’s Express locations. Please contact a specific location for participation details: https://tommys-express.com/locations.
- You may not use a gift card to purchase a wash if you are a Pay Per Wash user.
- You agree to allow Tommy’s Express and the Operator to recognize and log your license plate number, and to collect, store, and use the personal information obtained through this App and your use of any Tommy’s Express car wash in accordance with the Privacy Policy of Tommy’s Express.
Warranties Disclaimed by Tommy's Express LLC
Tommy's Express LLC takes no responsibility for any claims or warranties that any Franchisee may make to consumers regarding its participation in the Gift Card Program or with respect to any Gift Cards. Franchisees are solely responsible for any claims and warranties that the Franchisee may make to the consumers. Tommy's Express LLC expressly disclaims any warranties or responsibility for any claims relative to the Gift Card Program, except to the extent made in writing by an authorized Tommy's Express LLC representative in a binding agreement with the Franchisee. Tommy's Express LLC expressly disclaims any warranties to or any responsibility for claims made by any consumer purchasing or seeking to purchase Gift Cards from a Franchisee through the Gift Card Program. In furtherance and not in limitation of the foregoing, Tommy's Express LLC is not responsible for the specific content of any Gift Cards, for any photographs, images, marks or logos included in any Gift Card design by the consumer or by the Franchisee. Consumers utilizing the Tommy's Express website to purchase Gift Cards expressly agree to comply with all applicable laws and regulations including without limitation, Federal, State and local laws and regulations governing intellectual property, commerce and postal regulations. Tommy's Express LLC expressly reserves the right to cancel or modify any Gift Card order that is not fully in compliance with these Terms and Conditions, and Merchant acknowledges and agrees that Tommy's Express LLC shall have no liability for or relating to any such cancelled or modified Gift Card order.
TOMMY’S EXPRESS LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, THE SOLE REMEDY, AND TOMMY’S EXPRESS LLC’S SOLE LIABILITY, WILL BE THE REPLACEMENT OF SUCH THE CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
