SMS Policy
Effective: January 26, 2024
- Purpose. This SMS Policy (“Policy”) outlines the guidelines for the use of text messages, also known as SMS, by Tommy’s Express LLC (“Tommy’s Express”, “we”, “us” or “our”) for communication with our customers and prospective customers.
- Opt-In. By providing your mobile number and opting in, you consent to receive text messages from Tommy’s Express, including text messages sent by an automatic telephone dialing system (“ATDS”), that include service notifications and reminders, weather alerts, and other relevant information. Additionally, you may be given the opportunity to receive promotional offers or deals and other marketing messages from us. Marketing Messages may require a two-step opt-in process (e.g., respond to a call to action, receive an initial opt-in request message, and once you have replied “Y” or “YES” or clicked the link provided in the message, you will receive an enrollment confirmation message). You agree that your consent to receive Marketing Messages shall continue indefinitely unless and until you opt-out as described in this Policy. Your consent to receive messages is not required as a condition of purchasing any goods or services.
- Opt-Out. You can opt-out of receiving SMS messages at any time by replying "STOP" to any message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.
- Privacy. We will only use your information to provide you the services you request and as set forth in our privacy policy, which can be found at tommys-express.com/privacy-policy.
- Message and Data Rates; Frequency. Message and data rates may apply. You are responsible for any fees incurred from your mobile service provider. If you have any questions about your text plan or data plan, it is best to contact your mobile service provider. Messages are recurring, and the frequency of those messages may vary. The number of text messages you receive may also depend on other factors, including how you use our services and whether you take steps to generate additional text messages from us (such as by sending a HELP request, as described below).
- Carriers. Supported carriers include all major United States carriers, including, AT&T, Verizon Wireless, T-Mobile®, Sprint, and others.
- No Liability. Tommy’s Express will not be liable for any delays in the receipt of any SMS messages, as delivery is subject to effective transmission from your mobile service provider. Carriers are not liable for delayed or undelivered messages. SMS MESSAGE SERVICES ARE PROVIDED ON AN “AS IS” BASIS, AND WE MAKE NO WARRANTY, EXPRESS OR IMPLIED, AND ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE, ARE HEREBY EXPRESSLY DISCLAIMED. Tommy’s Express reserves the right to terminate the texting service, in whole or in part, at any time without notice.
- Customer Support. If you are experiencing issues with the SMS messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at support@tommys-express.com.
- Policy Changes. Tommy’s Express reserves the right to modify this SMS Policy at any time. Any amendments will be effective upon our posting of the updated Policy on this Site. If you have opted-in to receive SMS messages, we may send a text message to note that this Policy has been amended. If you remain opted-in to receive SMS messages following such notice, you thereby agree to the amended Policy. Your sole remedy if you do not agree with the revised Policy is to opt-out as provided in this Policy.
By opting in, you acknowledge and accept the terms of this SMS Policy.
